PA JUDGE DENIES TRO, BUT LEAVES MATTER OPEN FOR HEARING UPON SERVICE ON OBAMA, DNC & FEC

UPDATED 6-22-08 @ 6:18 PM CDT

Below is an update on the suit brought against Obama, the DNC and the FEC.  I have a thought and want to share it.  If there is a valid question, which there is, to the Constitutionality of Obama’s eligibility to run for POTUS, what difference does it make what the Plaintiffs political party is?  The fact that this Federal Judge asked those questions rather than addressing the Constitutional Eligibility of Barack Obama’s candidacy, and the fact that this was an open court hearing that the American Media has yet to report makes clear the DNC and Barack Obama are to be exempt from the Laws of and the Constitution of The United States of America.

UPDATE on Berg v. Obama Lawsuit

5:15pm

I’ve obtained copies of the hearing proceedings and the order denying the TRO. The order actually says that the hearing was conducted in open court–not behind closed doors as I had been informed–and I am kicking myself for not sitting in.

Expect more here at America’s Right on where the proceedings go from here and what it all means — just as soon as I go home and eat a nice dinner with my lovely wife and beautiful daughter.

I should bring flowers, as I expect to spend this evening as I did yesterday, sitting in my home office in front of the computer. Flowers work, right?

This afternoon a Philadelphia US District Court Judge denied the emergency TRO requested against Barack Obama, and the DNC.  However, the Judge left the matter standing and the option open to be heard again once the Defendants Barack Obama and the DNC are served.

UPDATE on Berg v. Obama Lawsuit

3:00pm
I just spoke with Philip Berg. The temporary restraining order was denied by the Hon. R. Barclay Surrick, but the exhibits have been taken into evidence and Judge Surrick has decided to leave the case open, allowing subject to once again be brought forth once all parties are served.

He mentioned that all related pleadings and documents can be found at ObamaCrimes.com, including the original complaint, the memorandum in support of the temporary restraining order, the press release, and more.

  3. Mr. Sinclair,

This Judge, Richard Barclay Surrick handled this correctly from a legal standpoint and from a national standpoint.
I would add that Judge Surrick is a Bill Clinton appointee from 2000 and sailed through confirmation hearings.
His background is 9 years as a public defender.

I doubt Mr. Berg, the attorney would have filed in a venue where he was not going to get a fair hearing. These are only 2 Jimmy Carter judges on the bench in the eastern district of Pennsylvania where the case is heard. The majority are Nixon, Reagan, Bush 41 and Bush 43 with 5 from Bill Clinton.
Judge Surrick came in with a group of 4 under ex President Clinton.

As odds go in fairness, Judge Surrick looks as good as one could hope for. He must realize he has before him thee biggest case since the Watergate drama.
He is proceeding with care knowing the stakes for his personal legacy. (That meaning if he does not expose Barack Obama and he is later exposed that the Judge will be a laughingstock.)
His judgements have been sound and he appears to be what this case needs.

One always hopes for the best and Judge Surrick in his past has always looked out for the people.
