The federal government is opposing a Michigan man's request to take the deposition of Treasury Secretary Timothy Geithner in a lawsuit that challenges the bailout of American International Group Inc. A lawsuit was filed in 2008 on religious grounds, claiming the government should not have bailed out AIG because the insurance giant sold financial products specifically tailored to Islamic principles. The lawsuit says AIG sells Takaful insurance, which is based on communal assistance that has been accepted by some Islamist religious officials. U.S. Magistrate Judge Mona Majzoub is scheduled to hear arguments Feb. 8. In May, U.S. District Judge Lawrence Zatkoff denied a request to dismiss the lawsuit at an early stage, saying the case raises questions about whether the government is promoting religion. The government filed a motion to dismiss which was denied. I have attached that opinion. Currently, we are in the throes of discovery and awaiting the court’s ruling on our motion to compel Secretary Geithner’s deposition, which was necessitated by the fact that the Fed and Treasury Rule 30(b)(6) deponents either testified inaccurately or feigned ignorance (no surprise to you I am sure). I have attached our Motion to Compel and our companion Response to the government’s Motion for Protective Order. I write to you today because in the course of our discovery investigation, we effectively uncovered a fraudulent artifice which allowed the Fed/FRBNY and the Treasury (using TARP funds) to accomplish that which it could not accomplish legally at the time (pre-EESA)—the acquisition of 77.9% of AIG’s equity and voting rights. We discovered this because we were looking at “standing” issues relative to the Fed/FRBNY funds provided to AIG under the Credit Facility approved in the latter half of Sept. 2008. But, what we learned was quite simply astounding. The FRBNY wanted more than just a standard debt deal; it wanted absolute control and ownership of AIG. But, it was illegal for the FRBNY to hold equity and the Treasury Dept. did not yet have the legislative authority, later granted under EESA, to do so. But this didn’t stop then-President Geithner or his general counsel Thomas Baxter. They crafted the AIG Trust to accomplish the same goal. But the Trust was transparently invalid and illegal for two fundamental reasons: One, the FED maintained absolute control over the Trust’s existence, its terms, and the Trustees through Section 1.03 of the Trust Agreement. This, as we explain in our Response papers attached, invalidates the trust; yet the government continues to speak about this as an “independent” Trust. Two, the Fed/FRBNY could not take legal title to the equity but neither could the Treasury Department during this pre-EESA period. So, the FRBNY named the U.S. Treasury (in the Trust Agreement) as the beneficial owner. But again, as our Response papers point out, it is elemental trust law that a beneficiary must be a person or entity that can actually hold title. While the Treasury Department can hold title, the U.S. Treasury can no more hold title than a bank account – because that is what it is. You can deposit funds or assets into a depository account but the account cannot have “ownership” because it has no more authority to do so than a tree log. But, the FRBNY had to conceal the fact that this transaction was really for the benefit of the Treasury Department (something the Treasury Dept’s Rule 30(b)(6) deponent conceded under oath (also provided in our Response papers), because the Treasury department had no legal authority. And, even if it did, as under EESA a few months later, to grant the federal government voting rights would be to create a Gordian Knot of conflicts-of-interest, which is why presumably the legislation seeks to avoid the government from taking both the equity and exercising voting rights. But, at the time of the AIG Trust, there was absolutely no legislative authority for the Treas. Dept to take control of AIG. Yet, this is what the purportedly Trust accomplished. In the world of finance, and you certainly know this as well as I, if you seek to accomplish an illegal financial transaction (“specified unlawful activity”) through false means (the Trust structure), you are in violation of federal anti-money laundering statutes (18 USC § 1956). O’Keefe was attempting to document Landrieu’s contempt for the American people in not answering the phone from outraged citizens. Landrieu claimed she wasn’t answering her constituents because — get this — her phones were broken. O’Keefe was videoing the working phones. Beautiful. James O’Keefe, a great American, was kept in jail without a lawyer for the crime of entering a Senator’s office pretending to be a telephone repairman (how many reporters have gotten stories by impersonating one thing or another?), while the Christmas balls bomber, Umar Farouk Abdulmutallab, who attempted to blow up a plane by making sure he was sitting in seat 19a (over the fuel tank) and setting off a bomb he was hiding in his underwear, was given a lawyer almost immediately. His sitting in seat 19A would ensure the greatest possible explosion over the densely populated Detroit area — and yet O’Keefe languishes without counsel while being prosecuted in the media, and Abdulmutallab gets lawyered up quicker than Pelosi can bang down a double on Air Force One. Got that? I guess the thought of the Indonesians tearing down the "Obama" statue less than a month after it was erected was too much to take for our narcissist in chief. Obama, Family Plan Trip to Boyhood Indonesian School in March Feb. 2 (Bloomberg) -- President Barack Obama will bring his wife and children on a trip next month to Indonesia, where he spent part of his childhood, as the U.S. seeks closer ties with the nation that has the world’s largest Muslim population. “This visit has a sentimental aspect and that’s why he’s bringing along his two daughters,” Indonesian presidential spokesman Dino Patti Djalal told reporters today. “The children will see where their father went to school,” he said, referring to Obama’stime in Jakarta where he studied at Catholic and state-run elementary schools from 1967 to 1971.[Media deception alert -he studied Islam]. “I was a little Jakarta street kid,” he said in a wide-ranging interview in his office (excerpts are on my blog, www.nytimes.com/ontheground). He once got in trouble for making faces during Koran study classes in his elementary school, but a president is less likely to stereotype Muslims as fanatics — and more likely to be aware of their nationalism — if he once studied the Koran with them. Mr. Obama recalled the opening lines of the Arabic call to prayer, reciting them with a first-rate accent. In a remark that seemed delightfully uncalculated (it’ll give Alabama voters heart attacks), Mr. Obama described the call to prayer as “one of the prettiest sounds on Earth at sunset.” Moreover, Mr. Obama’s own grandfather in Kenya was a Muslim. Mr. Obama never met his grandfather and says he isn’t sure if his grandfather’s two wives were simultaneous or consecutive, or even if he was Sunni or Shiite. (O.K., maybe Mr. Obama should just give up on Alabama.) Now back to the Indonesia Trip article: Obama plans to formally announce a U.S. partnership with Indonesia during the trip, which will take place in the second half of March, the U.S. embassy in Jakarta said in a statement. The pact, discussed in a November meeting between Obama and Indonesian President Susilo Bambang Yudhoyono, will include ways to enhance bilateral investment, Djalal said. Talks on climate change may also come up, Djalal said. Indonesia trails only the U.S. and China as the biggest carbon dioxide emitting nations when greenhouse gases from deforestation and land-use changes are included, according to the World Wildlife Fund. The U.S. and Indonesia signed up to the Copenhagen accord, which contains numerical goals for all major greenhouse-gas emitters. Mufti was head of the Arab Higher Committee. This document is a real indictment of the Arab Committee and the Mufti for abetting the destruction of European Jewry during the Shoah. The head of the Arab Higher Committee was the Mufti Haj Haj Amin el-Husseini, a brutal jihadi responsible for repeated massacres of the Jews prior to the Holocaust. The Arab Higher Committee, representing the six Arab parties of Palestine, came into existence in 1936. A year later it was established that the Mufti and his associates in the Arab Higher Committee were responsible for the 1936 riots which took a toll of hundreds of British, Jewish, and Arab lives. Accordingly, the Palestine government in 1937 declared the committee illegal and ordered it disbanded. Some of its members were arrested and sent to Seychelles. Others, including its chairman, the Mufti of Jerusalem, escaped to Syria whence they continued to direct Arab operations. During his exile in Syria, the Mufti even succeeded in liquidating most of the Arab leaders of Palestine who opposed him and his policies. Until 1943, the Arab Higher Committee had no formal existence. The Mufti, in the interval, had moved from Syria to Iraq where he organized the revolt against the British in 1941. When that failed, he fled to Germany and there played his role as Axis ally in the war against the United Nations. In 1943, a number of prominent Palestinian Arabs made an effort to establish an Arab Higher Committee but were prevented from achieving their purpose by followers of the Mufti who had remained in Palestine during the war and who feared that, in the absence of the Mufti, the new body would oust them from leadership. In 1944, however, the effort to establish an Arab Higher Committee was given stimulus when the Arab states, under British incentive, began to form what has now become known as the Arab League. In September of that year, political leaders from the neighboring Arab countries came to Palestine to urge Palestinian Arabs to agree among themselves on the composition of an Arab Higher Committee. These attempts again met with failure, due in every instance to the opposition of the followers of the Mufti who were hopefully awaiting his return from Germany and his resumption of leadership. A temporary truce was established in 1944 when Musa el Alami, a mild supporter of the Mufti, was recognized by the Arab league as the sole representative of Palestinian Arabs, pending the formation of a Palestine Arab Higher Committee. A few months after V-E Day, when the Husseini family, to their great astonishment, found that the British were reluctant to try the Mufti as a war criminal, they were emboldened openly to demand the return of the Mufti and his aides to Palestine. In this they were joined by the Arab states and the Arab League. The League was the culmination of more than four years of effort which had been encouraged by Anthony Eden, then, Foreign Secretary of Great Britain [1]. Sadly, we will see this Jew hatred repeatedly in the Brits. Time and again, they sided with the annihilationists. It is no small wonder their country today is overrun by the very evil they empowered. Karma. Back to the Mufti's early and pre-eminent role in the Third Reich. The captured files of the German High Command in Flansburg at the war's end reveal that the Arab [Muslim] riots of 1936 in Palestine [Israel] were carried out by the Mufti with funds supplied by the Nazis. The report states: "only through funds made available by Germany to the Grand Mufti of Jerusalem was it possible to carry out the revolt in Palestine." [source 1 page 5] The Muslim riots of 1936 were merely a continuation of the 1929 riots that led to the massacre of 133 Jews, 239 wounded. It is apparent, early on, that the Grand Muslim Mufti meant to wipe the Jews off the map. The Shaw Commission, appointed by the British Government to investigate the 1929 riots, attributed to the Mufti a share in responsibility for these riots, in which 133 Jews were killed and 239 wounded. No action was taken to curb his activities, with the result that in 1936 he again was responsible for new attacks upon the Jews of Palestine. At the same time, he caused the assassination on hundreds of prominent Arabs, including 24 leading Palestine Arabs who refused to accept his leadership. An investigating committee appointed by the legitimate Iraq Government, following its restoration after the revolt in 1941, declared that the causes of disturbance, “are, in the opinion of the investigating committee, Nazi propaganda emanating from the following sources: (1) the German League; (2) the Mufti of Jerusalem and his henchmen who followed him to Iraq. This man was accorded enthusiastic reception in Iraq and has turned it to his own use to disseminate many-sided Nazi propaganda. His influence on government and army circles became so strong that he could give orders to his group to set to work to spread anti-Jewish and anti-British propaganda among all classes of the population.” In Iraq, the Mufti’s first undertaking was to organize the Iraqi revolt with Jamal el Husseini, now Vice-Chairman of the Arab Higher Committee, as his Chief of Staff. After the failure of the Iraqi revolt, the Mufti escaped to Teheran and found refuge in the Japanese Embassy. From there he escaped to Italy. In October of 1941, he conferred with Mussolini, Ciano, and Dino Alfieri. From Rome he communicated with Balkan Moslems under Italian rule in Yugoslavia and Albania. In November 1941, he went to Berlin. The Nazis established a special office for him in Berlin entitled, “Buro des Grosmufti,” with branches organized later in other parts of Germany and Italy. His activities included propaganda, espionage, organization of Moslem military units in Axis-occupied countries and in North Africa and Russia, establishment of Arab legions, of an Arab brigade and organization of fifth-column activities in the Middle East, including sabotage and parachutist expeditions. In the course of his propaganda work, the Grand Mufti had at his disposal not only the German-controlled radio, but radio stations in Bari, Rome, Tokyo and Athens. In addition, he was responsible for sending to the Middle East various propaganda publications in Arabic. His espionage service extended throughout the Middle East. He had a sub-office in Geneva linking him to Egypt and Turkey, and another in Istanbul, branching out all along the Syrian-Turkish frontier in Mersine, Alexandretta, Antioch, Adana and Diarbekr. These stations received information directly from the Mufti’s agents in Palestine, Syria, and Iraq, and maintained close contact with members of the German Intelligence in Turkey. In Athens, the Mufti established a parachutist and sabotage school for Arabs. In The Hague, under his direction, Arab students were trained in wireless transmission, high explosives and demolitions. The Mufti’s agents were parachuted into Palestine, Syria and Iraq. A number of them were caught by the British. On a number of occasions these agents, with the help of local Arabs, cut telephone and pipe lines in Transjordan and Palestine and sabotaged railways and bridges in Iraq. Another of the Mufti’s accomplishments was the organization of Moslem military units. He attempted to recruit for the German military command some 500,000 soldiers from Morocco, Tunisia, and Algeria. In Asiatic Russia, he collaborated with Moslem Russian Quislings and White Russian traitors whom he helped to form pro-Axis legions. In 1942, he started to organize Axis Arab legions from among Arab students in Germany and Arab prisoners of war who followed him to Germany. His Legionnaires wore the German uniform with “Free Arabia” patches on their shoulders. After the Jewish Brigade had been recognized by Winston Churchill in 1944, the Mufti, on November 2, with the consent of Ribbentrop called upon all Arabs in Germany hailing from Palestine, Iraq, Egypt, and Syria to join the Arab Brigade. Accepting a proposal of the Japanese that he broadcast to Moslems in the South Pacific and India, the Mufti recorded numerous broadcasts which were beamed to India, Indonesia and Java. The Mufti at Berlin Broadcast On September 3, 1941, Major General Erwin Lahousen, one of the top officials of the Abwehr, whose secret diary was among the captured German documents, wrote: “The Grand Mufti, who left Iraq to go to Iran, is currently in connection with the Abwehr II (Sabotage division of the Abwehr). According to reports from Teheran he is safe with the Japanese envoy.” A year later, on June 2, 1942, Lahousen wrote in his secret diary: “The Italian national, Captain Simen, took part in discussions with the Grand Mufti concerning the utilization of the connections with the Grand Mufti for the purpose of Abwehr II, in order to demonstrate the solidarity of the Axis powers.” A month later, on July 13, 1942, Lahousen made the further entry in his secret diary: “A meeting between the chief of the Abwehr” (Admiral Canaris, who was also Hitler’s representative in arranging for the Franco revolt against the Spanish Republican government) ; “and the Grand Mufti of Jerusalem took place in the apartment of the chief. I (Lahousen) took part in the discussion. The Mufti made an offer to the chief that the followers of the Arabian Freedom Movement, which was led by him as well as the followers of the former Iraq Prime Minister, Kailani (leader of the Iraqi revolt against Britain), were to be used for purposes of sabotage and sedition in the Near East in accordance with the purposes of Abwehr II.” THE MUFTI'S WWII FATWAH AGAINST BRITAIN

This commentary by Ayn Rand, excerpted from The Voice of Reason, was originally published two weeks after Marilyn Monroe's death on August 5, 1962.
The death of Marilyn Monroe shocked people with an impact different from their reaction to the death of any other movie star or public figure. All over the world, people felt a peculiar sense of personal involvement and of protest, like a universal cry of "Oh, no!"
They felt that her death had some special significance, almost like a warning which they could not decipher--and they felt a nameless apprehension, the sense that something terribly wrong was involved.
They were right to feel it.
Marilyn Monroe on the screen was an image of pure, innocent, childlike joy in living. She projected the sense of a person born and reared in some radiant utopia untouched by suffering, unable to conceive of ugliness or evil, facing life with the confidence, the benevolence, and the joyous self-flaunting of a child or a kitten who is happy to display its own attractiveness as the best gift it can offer the world, and who expects to be admired for it, not hurt.
In real life, Marilyn Monroe's probable suicide--or worse: a death that might have been an accident, suggesting that, to her, the difference did not matter--was a declaration that we live in a world which made it impossible for her kind of spirit, and for the things she represented, to survive.
If there ever was a victim of society, Marilyn Monroe was that victim--of a society that professes dedication to the relief of the suffering, but kills the joyous.
None of the objects of the humanitarians' tender solicitude, the juvenile delinquents, could have had so sordid and horrifying a childhood as did Marilyn Monroe.
To survive it and to preserve the kind of spirit she projected on the screen--the radiantly benevolent sense of life, which cannot be faked--was an almost inconceivable psychological achievement that required a heroism of the highest order. Whatever scars her past had left were insignificant by comparison.
She preserved her vision of life through a nightmare struggle, fighting her way to the top. What broke her was the discovery, at the top, of as sordid an evil as the one she had left behind--worse, perhaps, because incomprehensible. She had expected to reach the sunlight; she found, instead, a limitless swamp of malice.
It was a malice of a very special kind. If you want to see her groping struggle to understand it, read the magnificent article in the August 17, 1962, issue of Life magazine. It is not actually an article, it is a verbatim transcript of her own words--and the most tragically revealing document published in many years. It is a cry for help, which came too late to be answered.
"When you're famous, you kind of run into human nature in a raw kind of way," she said. "It stirs up envy, fame does. People you run into feel that, well, who is she--who does she think she is, Marilyn Monroe? They feel fame gives them some kind of privilege to walk up to you and say anything to you, you know, of any kind of nature--and it won't hurt your feelings--like it's happening to your clothing. . . . I don't understand why people aren't a little more generous with each other. I don't like to say this, but I'm afraid there is a lot of envy in this business."
"Envy" is the only name she could find for the monstrous thing she faced, but it was much worse than envy: it was the profound hatred of life, of success and of all human values, felt by a certain kind of mediocrity--the kind who feels pleasure on hearing about a stranger's misfortune. It was hatred of the good for being the good--hatred of ability, of beauty, of honesty, of earnestness, of achievement and, above all, of human joy.

An eager child, who was rebuked for her eagerness--"Sometimes the [foster] families used to worry because I used to laugh so loud and so gay; I guess they felt it was hysterical."
A spectacularly successful star, whose employers kept repeating: "Remember you're not a star," in a determined effort, apparently, not to let her discover her own importance.
A brilliantly talented actress, who was told by the alleged authorities, by Hollywood, by the press, that she could not act.
An actress, dedicated to her art with passionate earnestness--"When I was 5--I think that's when I started wanting to be an actress--I loved to play. I didn't like the world around me because it was kind of grim--but I loved to play house and it was like you could make your own boundaries"--who went through hell to make her own boundaries, to offer people the sunlit universe of her own vision--"It's almost having certain kinds of secrets for yourself that you'll let the whole world in on only for a moment, when you're acting"--but who was ridiculed for her desire to play serious parts.
A woman, the only one, who was able to project the glowingly innocent sexuality of a being from some planet uncorrupted by guilt--who found herself regarded and ballyhooed as a vulgar symbol of obscenity--and who still had the courage to declare: "We are all born sexual creatures, thank God, but it's a pity so many people despise and crush this natural gift."
A happy child who was offering her achievement to the world, with the pride of an authentic greatness and of a kitten depositing a hunting trophy at your feet--who found herself answered by concerted efforts to negate, to degrade, to ridicule, to insult, to destroy her achievement--who was unable to conceive that it was her best she was punished for, not her worst--who could only sense, in helpless terror, that she was facing some unspeakable kind of evil.
How long do you think a human being could stand it?
That hatred of values has always existed in some people, in any age or culture. But a hundred years ago, they would have been expected to hide it. Today, it is all around us; it is the style and fashion of our century.
Where would a sinking spirit find relief from it?
The evil of a cultural atmosphere is made by all those who share it. Anyone who has ever felt resentment against the good for being the good and has given voice to it, is the murderer of Marilyn Monroe.

The Arab Higher Committee of Palestine is a creature of the Arab League comprising Egypt, Iraq, Syria, Lebanon, Transjordan, Saudi Arabia and Yemen. The head of the Arab Higher Committee is the ex-Mufti of Jerusalem, Haj Amin el-Husseini, a full partner of the Axis before and during World War II, an escaped prisoner of war who has found asylum in the Palace of the King of Egypt.

Haj Amin al-Husseini has a long-time record of complxity with terrorism, responsible for the Arab riots in Palestine in1920, he fled to transjordan to escape a ten year sentence of imprisonment, returning only after complete amnesty had been granted. [page 4]
