Dear Editor:
 
I suggest that one should read the following facts and opinions before anyone decides whether or not Israel should negotiate with the Palestinians at this time.
The Palestinian Liberation Organization (PLO) was created in 1964 three years before the 1967 war with the issuance of the 1964 Charter.  This Charter was an extremely important document which formalized the underlying concepts of the Palestinian leadership.  The principal themes of the Charter were liberation of Palestine, the declaration that the establishment of Israel is illegal and void, and that armed resistance must be utilized until Israel is eliminated. 
Palestinians did not control any land in 1964.  Jordan governed the West Bank and East Jerusalem and Egypt ruled Gaza.  Article 24 of the Charter specifically states “This organization does not exercise any regional sovereignty over the West Bank in Hashemite Kingdom of Jordan, or the Gaza Strip . . .”
The PLO by excluding Jordan and Egypt controlled zones, could only have meant that the liberation of Palestine was the elimination of Israel since Israel was the only other territory in the area.
The Charter was amended in 1968 with the elimination of Article 24 which was no longer applicable because Israel now ruled these areas after the 1967 war.
The PLO through various terrorist groups and the intifada, relentlessly carried out the armed resistance articles of the Charter until the early 1990’s when secret Oslo negotiations began.  During those negotiations, Israel continuously insisted that the onerous clauses of the Charter had to be annulled.  Arafat repeatedly asserted that the changes would be made or that they had been made.
Arafat as the chairman of the PLO wrote a letter in September 1993 to then Prime Minister Rabin in which he stated that the PLO renounces the use of terrorism, other acts of violence, and will assume responsibility over all PLO elements to assure their compliance.  Arafat further stated that articles of the Covenant which deny Israel’s right to exist, and the provisions of the Charter which are inconsistent with the commitments of this letter are now inoperative and no longer valid.  These Arafat statements had no validity because the Covenant (Charter) Article 33 specifically states that the PNC is the only entity which can amend the Charter.
On April 24, 1996, the Palestinian National Council (PNC) convened in Gaza and adopted a resolution concerning the Covenant by a vote of 504 to 54 with 14 abstentions.  Translated from the Arabic, the text of the resolution read as follows:
 “It has been decided upon:
1.      Amending the National Charter by cancelling the articles that are contrary to the letter exchanged between the PLO and the government of Israel, on September 9 and 10, 1993
2.      The empowerment of a legal committee with the task of redrafting the National Charter.  The Charter will be presented to the first meeting of the Central Council.”
There is no record that a committee was ever formed; nor that a redrafted Charter was ever drawn.
Almost two years later, Arafat wrote a letter to President Clinton in January 1998 (letter enclosed) in which he made certain statements which did not coincide with facts.
For example, he stated that the April 1996 PNC resolution is a comprehensive amendment of the Covenant.  All of the provisions of the Covenant which are inconsistent with the PLO commitment to recognize and live in peace side by side with Israel are no longer in effect.
He then listed the specific articles of the Covenant which have been nullified and parts of specific articles which are inconsistent with the above mentioned commitments are also nullified.
Arafat ended the letter with his assurance on behalf of the PLO and the Palestinian Authority: “I can assure you on behalf of the PLO and the Palestinian Authority that all the provisions of the Covenant that were inconsistent with the commitments of September 9/10, 1993 to Prime Minister Rabin, have been nullified.”
There is no record of any formation or any meeting of the Committee which was supposed to be formed pursuant to section two of the 1996 PNC resolution and there is no record that the PNC ever agreed to these alleged nullifications.  Also, there is no evidence to sustain Arafat’s assurance that any part of the Charter has been nullified.
Eleven months later in December 1998, the PNC voted to accept the content of the Arafat letter to President Clinton.  In effect, they voted to accept the content of an Arafat letter which contained almost all factually incorrect information.
This vote was accepted by President Clinton and Prime Minister Netanyahu as meeting the obligations of annulling onerous clauses of the Charter.
In actuality, both PNC votes were based upon Arafat letters which were replete with misstatements of material facts.
Even if one were to accept either or both PNC votes as annulments of articles of the Charter, nobody can disagree with the fact that as of this moment, not one word of the Charter has ever been changed.  Thus, the U.S. and the E.U. are trying to force Israel to negotiate with an entity which declares that the establishment of Israel is illegal and void and that they will resort to armed resistance to destroy Israel.  Additionally, the enormous loss of Israeli civilian lives from Palestinian terrorism after Israel’s divestitures of land arising out of the Oslo and Wye accords, illustrate that Arafat and the PLO promises to rein in the terrorist groups were worthless.
